a. Standard. The term "indigent" as used in these rules means a person who is not financially able to employ counsel.
b. Questionnaire. A defendant desiring to proceed as an indigent shall complete under oath a questionnaire concerning that defendant's financial resources, on a form approved by the Supreme Court. The defendant shall be examined under oath regarding defendant's financial resources by the judge, magistrate, or court commissioner responsible for determining indigency. The defendant shall, prior to said questioning, be advised of the perjury penalties as set forth in A.R.S. ยง 13 2701 et seq.
c. Reconsideration. After a determination of indigency or non-indigency has been made, if there has been a material change in circumstances, either the defendant, the appointed attorney, or the prosecutor may move for reconsideration of that determination.
